1. Introduction

Welcome to www.trinityclassicalschool.org.za (“Website”), owned and operated by Trinity Classical Christian School (“Trinity”, “the Organisation”, “we”, “us” or “our”). These terms and conditions of use (“Terms”) set out the terms that regulate the use of the Website by the user (“you”, “your” or “yourself”).

2. Acceptance of Terms

These Terms take effect as soon as you access the Website and constitute a binding agreement between the Organisation and yourself. The current version of these Terms will govern both the Organisation’s and your rights and obligations each time you access this Website.

If you do not agree with any provision contained in these Terms, you must immediately cease to use the Website. Your failure to do so, and your continued use of and access to the Website, will mean that you have read, understood and agree to be bound in full by the provisions of these Terms. Unless the contrary is specified, these Terms apply whether you use and access either free or paid-for services offered by the Organisation on the Website.

3. Use of the Website

By accessing the Website, you warrant and represent that (i) your use of the Website is for lawful purposes, (ii) you are over 18 (eighteen) years of age, or are accessing the Website with the knowledge and consent of a parent or guardian, and (iii) you can legally conclude a binding agreement with the Organisation. You further warrant that you will not contravene any South African or international laws by using the Website, any services offered on the Website, or any information provided to you by the Organisation through your use of the Website.

Except as expressly authorised by these Terms, you may not use, alter, copy, distribute, or transmit any content contained on this Website.

4. Intellectual Property

Unless otherwise indicated, the Website and all content on it — including text, graphics, logos, the Trinity name and crest, photographs and the arrangement of the foregoing — is the property of the Organisation or its licensors and is protected by South African and international intellectual property laws.

You may view, download and print pages from the Website for your own personal, non-commercial use, provided you keep intact all copyright and other proprietary notices. Any other use, including reproduction, modification, distribution, or republication of any content on the Website without the Organisation’s prior written consent, is strictly prohibited.

5. Disclaimer

The Website and its content are provided “as is” and “as available”, without warranty of any kind, whether express or implied. The Organisation makes reasonable efforts to ensure the accuracy and currency of the information published on the Website, but does not warrant that such information is complete, accurate, or up to date, and accepts no liability for any error or omission.

The Organisation does not warrant that the Website will be uninterrupted, timeous, secure, or free from viruses or other harmful components, and will not be held liable for any damage, loss, or harm arising from your use of, or inability to use, the Website.

6. Limitation of Liability

To the maximum extent permitted by law, the Organisation, its directors, employees and agents will not be liable for any direct, indirect, incidental, special or consequential loss or damage of any kind arising out of, or in connection with, your access to or use of the Website, whether based on contract, delict, or any other legal theory, and whether or not the Organisation has been advised of the possibility of such loss or damage.

Nothing in these Terms is intended to limit any right that you may have as a consumer under South African law that cannot lawfully be excluded or limited.

7. Indemnity

You agree to indemnify and hold the Organisation, its directors, employees and agents harmless against any claim, loss, liability, damage or expense (including reasonable legal costs) arising out of your breach of these Terms or your misuse of the Website.

9. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any dispute arising out of or in connection with these Terms or your use of the Website will be subject to the exclusive jurisdiction of the South African courts.

10. Changes to These Terms

The Organisation may, in its sole discretion, update, amend or replace these Terms from time to time, with or without notice. The current version of these Terms will always be available on the Website, and your continued use of the Website after any change constitutes your acceptance of the updated Terms.
